Terms of Service
These Terms govern access to and use of LTC.CARDS, the online marketplace operated by Lanzone Trading Company, including listings, buying, selling, offers, messaging, account features, tools, and related services.
1. Acceptance and Scope
These Terms of Service (“Terms”) govern access to and use of the LTC website, applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and any policies or disclosures referenced by them and posted on the Services (including fee disclosures and marketplace rules). If you do not agree, you must not use the Services.
2. Definitions
- “LTC,” “LTC.CARDS,” “we,” “us,” means Lanzone Trading Company, doing business as “LTC.CARDS.”
- “User” means anyone who accesses or uses the Services.
- “Buyer” means a User who purchases or attempts to purchase an item through the Services.
- “Seller” means a User who lists, offers, or sells an item through the Services.
- “Listing” means any offer to sell an item through the Services.
- “Order” means a completed transaction through the Services.
- “Content” means text, images, listings, messages, reviews, and other materials submitted through the Services.
- “Fees” include marketplace fees, processing fees, withdrawal fees, subscription fees, and other fees disclosed on the Services.
- “Transaction Taxes” means sales, use, VAT, GST, marketplace facilitator, or similar transaction-based taxes and government fees.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a legally binding contract. You may not use the Services if you are prohibited by law or if your access has been suspended or terminated.
4. Accounts, Security, Electronic Communications
4.1 Account information and security
You agree to provide accurate and complete information and to keep it current. You are responsible for safeguarding your login credentials and for all activity that occurs under your account, whether or not authorized by you. You must notify LTC promptly of any suspected unauthorized access or security breach.
If you choose to add or verify a phone number, you represent that the number you provide is your number or that you are authorized to receive messages at that number.
4.2 Electronic communications
You consent to receive communications electronically (including email, platform notifications, and postings on the Services). You agree that electronic communications satisfy any legal notice requirements.
4.3 Text messages, phone verification, and SMS program terms
LTC may offer phone verification, one-time passcodes, account security messages, account recovery messages, and other limited text messaging features. By voluntarily providing your mobile number and explicitly consenting in the applicable opt-in flow, you agree to receive text messages from LTC for the purpose described in that flow. Program name: LTC.CARDS.
- Message purpose: account verification, security, account access, account recovery, and other account-related service messages described when you opt in.
- Message frequency: message frequency varies depending on your activity and may be as limited as one message per verification or login attempt.
- Customer care: contact contact@ltc.cards for support.
- Opt-out: reply STOP to opt out of supported recurring text message programs. Reply HELP for help where supported.
- Fees notice: message and data rates may apply.
Consent to receive text messages is not a condition of purchase. However, if you request a phone verification or other security action that requires a one-time code, you understand that the requested text message is part of completing that security step.
Additional terms, disclosures, or message-specific details presented in the opt-in flow, including links to the Privacy Policy and these Terms, are incorporated into and form part of these Terms for that messaging feature.
5. Marketplace Role
LTC provides a platform that allows Users to list and purchase items. Unless explicitly stated otherwise, LTC is not a party to the contract of sale between Buyer and Seller, does not take title to User-listed items, and does not take possession of items.
Sellers are responsible for their Listings and transactions, including accuracy, authenticity, legality, pricing, shipping, and customer service. Buyers are responsible for reviewing Listing details and making informed purchase decisions.
6. Seller Rules
6.1 Listing accuracy and condition
Sellers must provide accurate and complete information for each Listing, including item identity, condition, edition/language, and any material defects. Listings must not be misleading.
6.2 Fulfillment
Sellers must ship within the handling time shown in the Listing (or otherwise stated at checkout), package items appropriately, and use shipping services consistent with any platform requirements for tracking, insurance, or signature confirmation.
6.3 Offers and binding transactions
If the Services allow offers, bids, or instant acceptance, submitting an offer/bid or accepting an offer can create a binding obligation to purchase or sell, subject to these Terms and any platform rules displayed at the time of the action.
7. Buyer Rules
Buyers are responsible for reviewing Listings before purchasing. Buyers must pay the total amount shown at checkout, including item price, shipping, and applicable taxes/government fees. Buyers must not engage in abusive behavior, fraudulent claims, or improper chargebacks.
8. Fees, Billing, Payouts, Subscriptions
8.1 Marketplace fee
LTC charges a marketplace fee equal to 5% on applicable transactions (as displayed on the Services). The marketplace fee is typically deducted from transaction proceeds prior to payout to the Seller. Together with the payment processing fee in Section 8.2, the combined Seller fee is 7.5% + $0.30 per order.
8.2 Payment processing fee
LTC charges a payment processing fee equal to 2.5% + $0.30 per order (as displayed on the Services). The processing fee is typically deducted from transaction proceeds.
8.3 Withdrawals
Withdrawing your available balance to a linked bank account is free; LTC does not charge a withdrawal fee. Withdrawal timing, any minimum amounts, and eligibility or verification requirements are described on the Services and may vary based on your account status and the risk controls in Section 8.5.
8.4 Billing authorization; collections; offsets
You authorize LTC to charge Fees you owe using your selected billing method(s), including a payment method on file and/or your LTC balance where applicable. Where permitted, you authorize LTC to recover amounts owed by offsetting them against your balance or future payouts.
8.5 Holds, reserves, payout delays, and risk controls
To manage fraud, disputes, and compliance obligations, LTC may place holds or reserves on payouts, delay withdrawals, require additional verification, limit account features, or otherwise restrict activity.
9. Taxes and Reporting
9.1 Transaction taxes (collection and remittance)
Where required by law or where LTC elects to do so, LTC may calculate, collect, and remit applicable Transaction Taxes on orders. When Transaction Taxes apply, they may be added to the Buyer’s checkout total and collected at the time of purchase. Sellers authorize LTC to collect and remit Transaction Taxes on their behalf where applicable.
9.2 Customs / import charges
Buyers are responsible for customs duties, import taxes, brokerage, and similar charges for cross-border shipments unless otherwise stated at checkout.
9.3 Seller income and business taxes
Except for Transaction Taxes collected/remitted under Section 9.1, Sellers are responsible for determining and paying taxes arising from their income and business activities.
9.4 Tax information, reporting, and withholding
LTC may be required to collect tax information, issue tax forms, report transactions, and/or withhold amounts and remit them to tax authorities. Reported amounts may reflect gross payments or proceeds as required by applicable rules.
10. Shipping, Delivery, Risk of Loss
Sellers are responsible for shipping items to the address provided at checkout within the stated handling time, using appropriate packaging. Tracking, insurance, and signature confirmation may be required for certain order values, destinations, or risk profiles.
11. Returns, Refunds, Disputes, Chargebacks
11.1 Returns and refunds
Return eligibility and refund terms depend on the Seller’s stated policy and any platform rules displayed at the time of purchase, except where prohibited by law. Items that are materially not as described, unlawful, or counterfeit may require a refund and/or other remedies.
12. Prohibited Items and Conduct
- Counterfeit, forged, or unauthorized replica items.
- Stolen goods or items obtained unlawfully.
- Fraud, money laundering, or attempts to evade fees or enforcement actions.
- Harassment, threats, impersonation, or abuse.
- Scraping/crawling/bots without written permission.
- Security probing, vulnerability exploitation, or service interference.
13. Content, Reviews, Intellectual Property
You retain ownership of Content you submit. You grant LTC a worldwide, non-exclusive, royalty-free license to host, store, use, reproduce, display, distribute, and create derivative works of your Content as necessary to operate, improve, secure, enforce, and promote the Services.
14. Tools and Estimates
Tools for collection tracking, scanning, identification, pricing, or grade estimates are provided “as is” for informational purposes only.
15. Suspension and Termination
LTC may suspend or terminate access to the Services for violations, suspected fraud, security risk, legal compliance, or to protect Users and the marketplace. Outstanding obligations remain due.
16. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LTC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LTC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
18. Indemnification
You agree to indemnify and hold harmless LTC and its officers, directors, employees, and agents from claims and expenses arising out of your use of the Services, your Content, your Listings, your transactions, or your violation of these Terms.
19. Dispute Resolution, Arbitration, Class Action Waiver
Before initiating a claim, you agree to attempt informal resolution by emailing contact@ltc.cards. Disputes may be subject to binding arbitration and a class action waiver to the extent permitted by law.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Montana. If arbitration does not apply, disputes will be brought in the state or federal courts located in Montana.
21. Changes to These Terms
LTC may update these Terms from time to time. Continued use after changes become effective means you accept the updated Terms.
22. General Provisions
Entire agreement. These Terms, together with any policies, disclosures, and rules referenced by them and posted on the Services, are the entire agreement between you and LTC regarding the Services and supersede any prior agreements on that subject.
Severability. If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver. LTC’s failure to enforce any provision is not a waiver of its right to enforce it later.
Assignment. You may not assign or transfer these Terms or your account without LTC’s prior written consent. LTC may assign these Terms, including in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure. LTC is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental action, power or network failures, or failures of third-party service providers.
Notices. LTC may provide notices to you through the Services, by email, or by other reasonable means. You may contact LTC as described below.
Survival. Provisions that by their nature should survive termination (including fees owed, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.
Headings. Section headings are for convenience only and do not affect interpretation.
